Address by Ian Martin Special Representative of the Secretary-General in Nepal On the Occasion of International Day of the World’s Indigenous People
Abstract:
Secretary-General Ban Ki-moon reported to the Security Council on 9 January this year: “If Nepal fails to meaningfully include traditionally marginalized groups in the peace process and in the election, and in the deliberations of the Constituent Assembly, the country will lose a crucial opportunity to harness the strength and vision of its own people and leave some of the key causes of the conflict unaddressed.” The agreement reached to ensure inclusion of Janajatis in the electoral process and the Constituent Assembly is a major step for Nepal’s indigenous peoples. It also highlights the need for continuing dialogue to ensure that there is consensus on the electoral system with Madhesis, Dalits and other traditionally marginalized groups. This will contribute to achieving the ultimate goal of the election: to produce a Constituent Assembly that is truly representative and able to frame a constitution which responds to the aspirations of all Nepalese people. #UNMIN

Abstract:
This year’s International Day of the World’s Indigenous People has particular resonance in Nepal, with the dialogue between Janajati representatives and the Government resulting in a positive outcome this week. I congratulate the talks team representing Janajatis, and the Government, on the perseverance and flexibility demonstrated in reaching a mutually acceptable position in relation to the Constituent Assembly election. In this week’s agreement between the Janajati and Government representatives, the Government made the commitment to adopt and ratify two important United Nations instruments. Firstly, the Government committed to adopt the Indigenous and Tribal Peoples’ Convention (known as Convention169 of the International Labour Organisation), which ensures consultation with and participation of indigenous communities and organisations. And secondly, it committed to ratify the Declaration on the Rights of Indigenous Peoples, which establishes international human rights standards for the protection of the rights of indigenous peoples. The Declaration was adopted by the Human Rights Council in June 2006, and the General Assembly is expected to adopt it in the coming days. UNMIN remains committed to working with all Nepalis to help create the conditions for a free and fair atmosphere for the Constituent Assembly election. Now is the time for political parties and civil society to work together at the local level to ensure a climate of public security in towns and villages across the country. Janajati communities have a major role to play in the building of inclusive democracy and lasting peace in Nepal. I congratulate you once again on your achievements so far, and I urge you to work with your communities to ensure widespread and peaceful participation in the election and in the broader peace process.
