Risk and Vulnerability Assessment of Transgender People in Nepal 2011
Abstract:
The report on the risks and vulnerability assessment of transgender people in Nepal comes at a juncture when the United Nations Human Rights Council passed a resolution calling for the universal rights of lesbian, gay, bisexual and transgender people. The resolution, adopted in June 17 2011, calls for a worldwide study to be conducted into discriminatory laws and practices based on sexual preferences and to look at how human rights law could be put to use to end related violence and human rights violations. Nepal is the only country in the Asia Pacifi c region where efforts to uphold the rights of the transgender population are in the forefront. On 21 December 2007 the Supreme Court ruled that the new democratic government must create laws to protect rights of lesbian, gay, bisexual and transgender people and change existing discriminatory laws. On 18 November 2008 the Supreme Court of Nepal further directed the government to enact laws enabling equal rights to lesbian, gay, bisexual and transgender citizens. While not explicitly legalizing same-sex marriage, the ruling instructed the government to form a committee to look into same-sex marriage. In Nepal census, conducted in May 2011, the Central Bureau of Statistics offi cially recognized third gender in addition to male and female categorization.
