राज्यले गम्भिर अपराधको अनुसन्धान गरी कसूरदारलाई सजायको मागदावी लिई अदालतमा मुद्दा दायार गर्दछ । अदालत्मा मुद्दा दायार गरेर मात्र पुग्दैन, सो बमोजिम कसुर ठहर भएमा मात्र अपराध गर्नेले सजाय पाउने, पीडितले न्याय पाउने र समाजले शान्ति, सुरक्षा र सुब्यवस्था पाउने हुन्छ । नेपाल सरकारवादी हुने मुद्दाको सफलतामा धेरै चूनौती तथा समस्याहरु रहेको छ । बिगत पाच बर्षको जिल्ला तह्को सफलता हेर्दा सफलता औसत ६९.४३ प्रतिशत रहेको देखिन्छ । यस परिप्रेक्षमा सरकारवादी फौज्दारी मुद्दाको असफलअताका कारणहरु पहिचानका लागि प्रस्तुत अध्यायन गरिएको हो ।
