Remarks by Jyoti Sanghera, Representative of OHCHR-Nepal
On the Occasion of an Interaction on
Equal Rights to Sexual Minorities: Right to Citizenship Certificate
|
Under the recent Universal Periodic Review in January and June 2011, the Government of
Nepal has also made specific commitments on the elimination of discrimination, including on the basis of gender identity and sexual orientation, and on the implementation of the
Supreme Court decision. The Government has agreed to “Enact legislation to ensure that the
citizenship rights of members of LGBTI community are consistent with the equal rights
enumerated in the 2007 Supreme Court decision” and to “Take steps to ensure non-
discrimination based on sexual orientation and gender identity including in the proposed civil and criminal laws”.
Through its commitments under the Supreme Court decision and the UPR review, Nepal is
uniquely placed as the only South Asian country recognizing equal rights to lesbian, gay,
bisexual, transgender and intersex persons. However, a series of challenges still have to be overcome to ensure protection and promotion of the human rights of sexual and gender
minorities and to ensure their equal treatment.
