सूचनाको हकलाई लोकतन्त्रको अनिवार्य शर्तको रूपमा लिने गरिन्छ । त्यसैले गर्दा सूचनाको हक सबैका चासो र सरोकारको विषय बनेको हो । नागरिकलाई राज्य सञ्चालनको प्रक्रियामा सहभागी गराउन उनीहरूलाई सो प्रक्रियाबारे जानकारी हुन जरुरी हुन्छ । यसका लागि नागरिकलाई राज्यल आवश्यक मात्रामा सूचना र जानकारी दिनु आवश्यक हुन्छ । राज्य तथा सार्वजनिक निकायबाट आफ्नो तथा सार्वजनिक सरोकारको विषयमा प्रश्न सोध्ने वा जानकारी पाउने अधिकारले व्यक्तिलाइ सार्वभौम भएको अनुभूति गराउँछ । त्यसैले सूचनाको हक कुनै पनि व्यक्तिको लागि महत्वपूर्ण अधिकारको रूपमा रहन्छ ।
सूचनाको हकको प्रयोगका दृष्टिले सूचना, जानकारी, तथ्याब्क, लिखतको प्रतिलिपि आदि महत्वपूर्ण विषय हुन् । यस सन्दर्भमा सूचना भनेको कुनै तथ्य, तथ्याब्क, घटना, प्रक्रिया र अवस्थाको यर्थाथ विवरण हो । सूचना एक किसिमको जानकारी हो, जसको आधारमा मानिसले कुनै विषयबार साक्षात्कार हुने अवसर पाउँछ । यस्ता सूचना विभिन्न प्रकारका र स्वरूपमा रहेका हुन सक्छन् ।
सबै सार्वजनिक निकायमा रहेका सूचना कुनै पनि नेपाली नागरिकले माग गर्ने र प्राप्त गर्ने अधिकार नै सूचनाको अधिकार हो । सामान्यतः सार्वजनिक निकायका कामकाजबारे नागरिकले जान्न पाउन अधिकारलाई सूचनाको हकभित्र समावेश गरिएको छ । सूचनाको हकलाई प्रयोग गरेर कुनै पनि देशको शासनव्यवस्था तथा कामकारबाही प्रजातान्त्रिक मूल्य, मान्यता र विधिमा आधारित भए / नभएका मापन गर्न सकिन्छ ।
सरकारका सबै कामकारबाही जनताप्रति उत्तरदायी हुनुपर्छ । सरकारी कामको प्रक्रिया र व्यवहार पारदर्शी तथा जवाफदेही हुनुपर्छ भन्ने मूल मर्म सूचनाको हकले बोकेको छ । जनताको करबाट सञ्चालन हुने सरकारले जनताले तिरेको कर कहाँ र कसरी खर्च भइरहेको छ भन्नेबारे जनतालाइ उचित जानकरी दिनुपर्छ । सूचनाको हकले सरकार तथा सार्वजनिक निकायलाई जनताप्रति जिम्मेवार र जवाफदेही बनाउने काम गर्दछ । त्यसैले सूचनाको हकलाई पारदर्शीता र जवाफदेही राज्य स्थापना गर्ने सशक्त औजारको रूपमा लिने गरिन्छ ।
