NHRI Background Briefs: Assessing the Capacity of National Human Rights Institutions in South Asia to Address Discrimination and Human Rights Relating to HIV, Sexual Orientation and Gender Identity (June 2012)

Conservative societal attitudes in South Asia towards sexual orientation and gender identity have a significantly adverse impact on the lives and rights of men who have sex with men (MSM), transgender people and people living with HIV (PLHIV). The research contained within this Desk Review reveals that while there has been progress, driven by civil society movements, jurisprudence or legislative change; there is room for further advancement.

Nepal is a signatory to both the International Covenant on Civil and Political Rights and the International Covenant on Economic, Social and Cultural Rights. These treaties contain protective provisions that are equally applicable to people of diverse sexualities (the Yogyakarta Principles). The National Human Rights Commission of Nepal is positioned to play a significant role in addressing human rights issues related to sexual orientation and gender identity (SOGI); however it is necessary to understand the legal and social context in Nepal, along with relevant laws that hinder or help the furtherance of the SOGI movement.

This Review includes research on the legal and social situation in Nepal as it relates to SOGI issues; as well as an examination of the powers, mandate and strategic plan of the National Human Rights Commission of Nepal. Civil society monitors play a vital role in promoting the rule of law and human rights and as such, reports prepared by key non-governmental organizations have also been considered in this Review.
