अपाङ्गता भ​एका व्यक्तिहरुको अधिकार​

नेपालको कुल जनसब्ख्याको ७ देखि १० प्रतिशत मानिसहरूमा कुनै न कुनै प्रकारको अपाङ्गता भएको अनुमान छ । प्राकृतिक रूपमा, दुघर्टना, प्रकोप, हिंसा, द्वन्द्व तथा कुनै महामारी तथा दीर्घकालीन रोगजस्ता विभिन्न कारणल जुनसुकै समयमा जुनसुकै पनि वर्गका व्यक्ति अपाङ्गता भएको व्यक्ति बन्न पुग्ने भए तापनि ती व्यक्तिहरूको मानव अधिकारको उचित संरक्षण र सम्वद्र्धन हुन सकेको छै।त्यसै गरी नेपालमा अपाङ्गता भएकै कारणबाट राज्यबाट प्राप्त हुने सेवा र सुविधामा विभेद गर्न तथा न्यायको सहज पहुच बाट समेत वञ्चित गरिएको पाइन्छ।यसरी अपाङ्गता भएका व्यक्तिहरूलाइ अधिकार उपभोग गर्नबाट वञ्चित गर्नु नैै मानव अधिकार उल्लब्घन हो। नेपाल अपाङ्गता भएका व्यक्तिहरूको अधिकारसम्बन्धी महासन्धि ९ऋच्एम्० एवम् स्वेच्छिक अनुबन्ध २००६ को २०६६साल पुस१२देखि पक्षराष्ट्र भएका हो उक्त महासन्धिले अपाङ्गता भएका व्यक्ति भन्नाले शारीरिक, मानसिक, वौद्धिक वा इन्दि«यसम्बन्धी दीर्घकालीन अशक्तताद्वारासृजित विभिन्न अवरोधहरूसँगको अन्तक्र्रियाको कारणले समाजमा अन्य व्यक्तिहरूसरह समान आधारमा पूर्ण र प्रभावकारी ढब्गमा सहभागी हुन बाधा भएको व्यक्तिसमेतलाइ परिभाषा गरेको छ। त्यस्तै गरी अपाङ्ग संरक्षण तथा कल्याण ऐन २०३९ ल अपाङ्ग भन्नाले सामान्य दैनिक दिनचर्या गर्न शारिरिक वा मानसिक तवरल असमर्थ वा असक्षम भएको नेपाली नागरिकलाई सम्भनुपर्छ भनेको छ ।
