गम्भीर मानव अधिकार उल्लङ्घन र युद्ध अपराधका दोषीहरुलाई आममाफी प्रदान गर्ने अधिकारसहितको संक्रमणकालीन न्याय संयन्त्रको गठन अन्तरास्ट्रिय कानुनन्तर्गत नेपालका प्रतिबद्धताहरुको विपरित हो । हाल राष्ट्रपतिसमक्ष सिफारिस भएको प्रस्तावित अध्यादेश जारी भएमा पिडितहरुको न्यायमा पहुँचलाई गम्भीर रूपमा अवमुल्यन गर्नुका साथै दण्डहिनतालाई थप संस्थागत गर्ने सम्भावना रहन्छ।
