Nepal is currently undergoing a historical process of change in the definition of its
political, legal and social make-up. The ongoing transition towards democracy, best represented in the constitution-making process, is an opportunity to improve the status and conditions of the social sectors that have been historically marginalized from political decisions and deprived of the full benefits of citizenship. The numerous culturally distinct groups that are regarded or regard themselves as Adivasi Janajati (indigenous peoples) are among these groups, and they have become a powerful voice in demanding recognition and respect for their human rights.
The present report follows a visit to Nepal by the Special Rapporteur on the situation of human rights and fundamental freedoms of indigenous peoples and focuses on the indigenous peoples of Nepal, comprehensively referred to as Adivasi Janajati. It reviews the human rights situation of the Adivasi Janajati, analysing the ongoing process of constitution-making and political transition as it relates to them and assessing the implementation of Nepal’s expressed commitment to secure their rights.
