नेपाल सरकार र नेकपा (माओवादी)ले २०६३ सालमा विस्तृत शान्ति सम्झौतामा हस्ताक्षर गर्दा उनीहरूले अन्तर्राष्ट्रिय
कानुनका केही प्रमुख सिद्धान्तहरूको पालना तथा सम्मान गर्ने कुरामा प्रतिबद्धता जनाएका थिए । जसमा द्वन्द्वका समयमा भएका घटनाका सम्बन्धमा सत्यतथ्य थाहा पाउने र अन्तर्राष्ट्रिय मानवअधिकार कानुन तथा मानवीय कानुनको गम्भीर उल्लङ्घनका पीडितहरूले न्याय र परिपूरण दुबै पाउने कुराको सुनिश्चित गर्ने लगायतका कुराहरू थिए ।
छ वर्षपछि पनि यी महत्वपूर्ण आकाङ्क्षाहरूलाई सफलीभूत पार्न धेरै काम गर्न बाँकी छ । यो प्रतिवेदन सार्वजनिक गर्दाको समयमा नेपालमा सङ्क्रमणकालीन न्याय संयन्त्रको रूपमा स्थापना गर्ने भनिएका सत्य निरूपण तथा मेलमिलाप आयोग र बेपत्ता छानबिन आयोग स्थापनासम्बन्धी कानुनलाई अझै अन्तिम रूप दिन सकिएको छैन । अन्तर्राष्ट्रिय मानवअधिकार कानुन तथा मानवीय कानुनका गम्भीर उल्लङ्घनका पीडकहरूलाई न्याय प्रणालीमार्फत जवाफदेही बनाइएको छैन र पीडित तथा तिनका परिवारहरू निरन्तर पीडामा छन्, जसलाई राज्यले आत्मसात समेत गरेको पाइँदैन ।
प्रस्तुत नेपालको द्वन्द्व प्रतिवेदनका साथै सङ्क्रमणकालीन न्याय सन्दर्भसामग्री (अभिलेख भण्डार)ले द्वन्द्वका क्रममा गरिएका गम्भीर मानवअधिकार उल्लङ्घनका लागि न्याय सुनिश्चित गर्ने जल्दोबल्दो कार्यमा महत्वपूर्ण योगदान पु¥याउने अपेक्षा गरिएको छ । द्वन्द्वसँग सम्बन्धित अन्तर्राष्ट्रिय मानवअधिकार कानुन तथा अन्तर्राष्ट्रिय मानवीय कानुनका २०५२ फागुन १ देखि २०६३ मङ्सिरसम्म भएका उल्लङ्घनका मुख्य प्रवर्गहरूको अभिलेखन तथा विश्लेषण गरेर यस प्रतिवेदनले सङ्क्रमणकालीन न्याय आयोग र अदालतहरूलाई आफ्ना कामलाई थप अगाडि बढाउन अनुसन्धानको आधार उपलब्ध गराउँदछ । यो प्रतिवेदन अनुसन्धान नभई अन्तर्राष्ट्रिय कानुनको गम्भीर उल्लङ्घन भएको आशङ्काका लागि मनासिब आधारसहितका विश्वसनीय आरोपहरूको पहिचान गर्ने एउटा प्रारम्भिक अभ्यास हो । कुनै न्यायिक प्रक्रियाबाट अनुसन्धान तथा अभियोजनलगायतका माध्यममार्फत सङ्क्रमणकालीन न्यायलाई अगाडि बढाउन यी आरोपहरूलाई सम्बद्ध राष्ट्रिय तथा अन्तर्राष्ट्रिय कानुनका सन्दर्भमा प्रस्तुत गरिएका छन् । प्रस्तुत अभिलेख भण्डारले पनि भावी सन्ततिका निम्ति सत्य उद्घाटन र जवाफदेहिताका लागि सम्बद्ध अभिलेखनको संरक्षण गर्न मद्दत गर्नेछ ।
विश्वभर मानवअधिकारको उपभोग तथा न्यायका लागि काम गरेका धेरै वर्षमा दण्डहीनताविरुद्ध लड्नमा भएको विफलता तथा न्यायको अस्वीकारले थप गम्भीर उल्लङ्घन गर्नमा दुरुत्साहन मात्र गरेको पाएको छु । त्यसैले, म यो प्रतिवेदन र अभिलेख भण्डारलाई हिंसात्मक तथा दुःखद् द्वन्द्वबाट नेपालले मुक्ति पाओस् तथा शान्तिका लागि दिगो जगको निर्माण गर्ने अत्यावश्यक प्रयासमा सहयोग पुगोस् भनी नेपाल सरकारलाई प्रदान गर्दछु ।
