कसैले कुनै पनि व्यक्तिलाई प्रथा,परंपरा, धर्म, संस्कृति,रितिरिवाज, जात, जाति, वंश, समुदाय वा पेशाका आधारमा जातिय भेदभाव वा छुवाछुत गरी र्सार्वजनिक वा निजि स्थानमा प्रवेश गर्न,उपस्थित हुन वा भाग लिन निषेध गर्ने वा कुनै किसिमले प्रतिवन्ध लगाउने वा व्यक्तिगत वा सामूहिक रुपमा र्सार्वजनिक स्थान वा समारोहबाट निष्काशन, सामाजिक वहिस्कार वा कुनै प्रकारको भेदभाव गर्ने वा सहन नसकिने व्यवहार गर्ने, र्सार्वजनिक समारोह आयोजना गर्नबाट वंचित गर्ने र्सार्वजनिक सेवा उपभोग गर्नबाट वंचित गर्ने, कुनै व्यवसाय गर्न प्रतिबन्ध लगाउने अथवा कुनै पेशा व्यवसाय गर्न वाध्य गराउने, कुनै धार्मिक कार्य गर्नबाट वचिंत गराउने, कुनै वस्तु, सेवा वा सुविधा उत्पादन, बिक्रि वा वितरण गर्न रोक लगाउने खास जातिको व्यक्तिलाई मात्र कुनै बस्तु, सेवा वा सुविधा, उत्पादन बिक्रि वितरण गर्न लगाउने र कुनै जातिका आधारमा परिवारका कुनै सदस्यलाई वहिस्कार गर्ने, घरमा प्रवेश गर्न नदिने वा घर गाउँवाटै निकाल्ने वा निस्कन वाध्य तुल्याउने गर्न पाइँदैन ।
